Record Keeping in Court
The Small Claims Court is not a court of record. There is no
requirement that the Commissioner keep notes of the proceedings or
that any of the evidence is recorded. Any recording equipment
present will probably only be used for Magistrates' Court sessions.
The requirement of speedy justice in the Small Claims Court is a
further reason why the Commissioner is not expected to record the
evidence.
